Disclosure Log Print Write e-mail

The NCA is required by the Freedom of Information Act 1982 (s.11C) to publish a Disclosure Log on its website from 1 May 2011.

The Disclosure Log will list information which has been released in response to a Freedom of Information (FOI) access request.

The Disclosure Log requirement does not apply to:

  • personal information about any person if publication of that information would be 'unreasonable'
  • information about the business, commercial, financial or professional affairs of any person if publication of that information would be 'unreasonable'
  • other information covered by a determination made by the Australian Information Commissioner if publication of that information would be 'unreasonable'
  • any information if it is not reasonably practicable to publish the information because of the extent of modifications that would need to be made to delete the information listed in the above dot points.

The information described in the Disclosure Log has been released by the NCA under the Freedom of Information Act 1982 and is available for public access. Where information is being released outside of the formal provisions of the FOI Act it is identified as such.

A link is provided if the information can be downloaded from this website or another website. Information that is not available on a website may be obtained contacting the Freedom of Information contact officer. A charge may be payable to reimburse the NCA for the cost incurred in copying or reproducing the information or sending it to you. There will be no charge for the time spent by the NCA in processing the FOI request that led to this information being made available. You will be notified if any charge is payable and required to pay the charge before the information is provided.

2013-14/1 18/10/2013

The applicant requested a copy of all Works approved by the NCA for buildings located at Section 24 Canberra City between 1 January 2006 and 30 June 2011, excluding any landscaping works.

The applicant was provided with all documents within the scope of the request. The documents were 6 works approved by the NCA between 10 February 2006 to 5 December 2006.

No deletions were made to the documents.

2012-13/4 16/07/2013

The applicant requested

  • All documents relating to complaints by the public regarding the condition of the concrete covers along Commonwealth Avenue including the Commonwealth Bridge extending right through to Vernon Circle and action taken regarding those complaints in the past 5 years;
  • All documents relating to the installation and maintenance of concrete covers along the western pedestrian footpath of Commonwealth Avenue including the Commonwealth Bridge extending right through to Vernon Circle in the past 5 years;
  • All documents relating to incidents involving the concrete covers on the pedestrian footpath of Commonwealth Avenue including the Commonwealth Bridge extending right through to Vernon Circle in the past 5 years; and
  • All documents relating to any incident on 24 November 2012 along the western footpath of Commonwealth Avenue including the Commonwealth Bridge extending right though to Vernon Circle.

The applicant was provided with all documents held by the NCA that were within the scope of the request including assessment reports, emails and invoices relevant to the request.

Deletions were made to some documents under section 22(1)(a)(ii) of the FOI Act as parts of these documents were not within scope of the request.

Material has been deleted under the following conditional exemption:

  • section 47F of the FOI Act – documents affecting personal privacy.
2012-13/3 05/02/2013

The applicant requested

  1. The 'second draft' of the diplomatic leasing review commenced by the National Capital Planning Authority in late 1993 (Note: Reference to this review is made in Australian National Audit Office Audit Report No.33 2007-08, The National Capital Authority's Management of National Assets, May 2008, pp 73-77; and
  2. All briefings, correspondence or other documents provided by the National Capital Authority to the Minister for Regional Australia, Regional Development and Local Government, the Hon Simon Crean MP, concerning the Review of Diplomatic Leasing Arrangements referred to on p.84 of the NCA's Annual Report 2011-12, and/or any report, findings or recommendations of that Review.

The applicant was provided with all documents held by the NCA that were within the scope of the request including reports, Incoming Ministers Briefs and Ministerial Submissions relevant to the request.

Deletions were made to some documents on the grounds of:

  • section 33 (a)(iii) – damage international relations of the Commonwealth
  • section 47C – documents disclosing deliberative matter
  • section 47D – financial or property interests of the Commonwealth.

Deletions were made to some documents under section 22(1)(a)(ii) of the FOI Act as parts of these documents were not within scope of the request.

2012-13/2 24/12/2012

The applicant requested

  1. All documents relating to the supply of land in Canberra for embassies and foreign missions in Canberra since 1 January 2008, including documents relating to planning for future demand for land.
  2. All documents relating to the 15 blocks of land set aside for embassies or foreign missions which are deemed unsuitable for diplomatic use (see paragraph 3.1, page 13 of the report 'Assessment of Three Sites for Diplomatic Use', authored by SGS Economics and Planning on a commission of the National Capital Authority), including documents showing the reasons for that assessment.
  3. All correspondence from the Department of Foreign Affairs and Trade relating to the demand for or supply of land for embassies and foreign missions in Canberra since 1 January 2008.

The applicant was provided with all documents held by the NCA that were within the scope of the request including emails between the NCA and third parties, internal NCA emails, plans, briefs, notes, reports relevant to the request.

Some documents were provided in full.

Deletions were made to some documents on the grounds of:

  • section 33 (a)(iii) – damage international relations of the Commonwealth
  • section 47 (1)(b) – commercially valuable information. section 47D – financial or property interests of the Commonwealth.
  • section 47F – documents affecting personal privacy.
  • section 47G – public interest conditional exemptions- business.

Deletions were made to some documents under section 22(1)(a)(ii) of the FOI Act as parts of these documents were not within scope of the request.
